Abstract
Ovaj završni rad obuhvaća tematiku korištenja akreditiva kao instrumenta plaćanja u međunarodnom platnom prometu. Akreditiv je najčešće korišteni instrument plaćanja upravo zbog svoje jednostavne primjene i obvezujuće uloge. Također, ima vrlo visok stupanj realizacije ugovorenog posla, što ovaj instrument plaćanja čini privlačim mnogim poslovnim subjektima. U radu su navedeni temeljni odnosi između strana navedenih u akreditivu. U akreditivnom poslovanju sudjeluju tri osobe, a to su kupac, prodavatelj i banka. Kupac i prodavatelj su izloženi raznim rizicima prilikom isporuke i plaćanja robe. Ti rizici očituju se kroz ekonomske, financijske ili valutne promjene te zbog toga trebaju sklopiti takav sporazum koji nalogodavcu kao kupcu osigurava isporuku robe, dok primatelju naloga kao isporučitelju robe osigurava naplatu iste. Sklapanjem akreditiva dobivaju određenu razinu zaštite. Za lakše korištenje akreditiva kao instrumenta plaćanja postoje različite vrste akreditiva koje omogućuju različite načine namirenja akreditivne obveze. U okviru dokumentarnog akreditiva, banke se bave isključivo dokumentima, ne i robom te je to ujedno glavno pravilo u ovakvom načinu poslovanja u međunarodnom prometu. Ovaj rad uz teoriju obuhvaća praktičan primjer samog procesa izdavanja dokumentarnog neopozivog akreditiva te isticanje njegovih prednosti. Primjer se odnosi na otvaranje neopozivog akreditiva između kupca iz Hrvatske te prodavatelja iz Turske u kojem sudjeluje Zagrebačka banka. d.d. kao akreditivna banka kupca. Isporuka između kupca i prodavatelja se odnosi na prodaju čistog čelika.
Abstract (english)
This paper explains using Letter of Credit (LC) as a payment mechanism in international trade. Letter of Credit is the most used payment mechanism because of its simplicity and contracting nature. Also, it has a high degree of business realization which makes if favored by many business entities. Paper mentions crucial relations between subjects being part of LC. This payment mechanism contains three subjects- a buyer, a seller and a bank. Buyer and seller are exposed to different types of risk during process of delivering goods and paying for them. Mentioned risks are shown through business, financial or currency changes and that creates a necessity to have a type of agreement, which makes sure buyer gets the goods delivered while seller gets the secured payment for them. Using LC gives both parties involved a needed level of security. There are different forms of LC and they offer multiple and easier ways of fulfilling obligations for all parties involved. In LC, as one of those forms, bank exclusive role is in dealing with the documentation while excluding handling the goods. While this paper offers insight in theoretical approach to subject of LC, it also offers a show of example in practice when using documentary LC which is irrevocable. The example in practice revolves around subjects from Croatia (buyer) and Turkey (seller) with Zagrebačka banka d.d. as a buyer's bank. It is about trade of pure steel.
